Terms of Service
These Terms of Service ("Terms") govern your access to and use of Trail Closet, including the Trail Closet website, marketplace, applications, features, services, and related tools (collectively, the "Service").

Trail Closet is operated by Delack Media Group dba Trail Closet ("Trail Closet," "we," "us," or "our").
By creating an account, listing an item, purchasing an item, or otherwise using the Service, you agree to these Terms and the policies incorporated into them by reference. If you do not agree, you may not use the Service.
These Terms contain a binding arbitration agreement and waiver of certain rights to have disputes decided in court or by a jury. Please review Section 22 carefully.
1. Trail Closet's Role
Trail Closet provides an online marketplace through which users can list, discover, buy, and sell outdoor gear and related products.
Unless expressly stated otherwise, items offered through Trail Closet are listed and sold by independent users of the marketplace. Trail Closet does not own or take possession of those items and is not the seller, manufacturer, distributor, or owner of member-listed products.
The purchase agreement for a member-listed item is between the buyer and seller. Trail Closet provides technology and services that facilitate transactions, which may include listings, search, messaging, checkout, payment facilitation, order information, transaction records, reviews, reporting, and dispute-support processes.
Trail Closet does not guarantee the existence, quality, safety, legality, authenticity, condition, suitability, or accuracy of any item or listing or guarantee that a buyer or seller will complete a transaction.
2. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into a binding contract to create an account or transact through Trail Closet.
You agree to provide accurate, current, and complete account information and keep that information current.
Accounts may be designated as individual or business accounts. Business sellers may display a business name publicly as their seller identity.
You are responsible for activity conducted through your account and for maintaining control of the email account and other credentials used to access Trail Closet.
You may not impersonate another person or business, provide materially false account information, transfer your account without authorization, or use another person's account without permission.
Trail Closet may require identity, business, tax, payment, payout, or other verification when reasonably necessary to operate the marketplace, comply with law, prevent fraud, or provide particular features.
3. Buying on Trail Closet
Before purchasing an item, buyers are responsible for reviewing the entire listing, including photographs, description, condition, disclosed defects or modifications, price, shipping or local-pickup terms, and the seller's stated return policy.
Purchases must be completed through Trail Closet's authorized checkout process.
Buyers agree to provide accurate payment and shipping information and cooperate reasonably with sellers and Trail Closet when necessary to complete or investigate a transaction.
Buyers may not misuse return, refund, chargeback, reporting, review, or dispute procedures.
If an item is materially different from how it was represented in the listing, the buyer may be eligible for protection under Trail Closet's Returns & Refunds Policy regardless of the seller's voluntary-return setting.
4. Selling on Trail Closet
By listing an item, you represent and warrant that:
- You own the item or have legal authority to sell it.
- Selling the item through Trail Closet is lawful.
- Your description and photographs accurately represent the actual item.
- Photographs represented as photographs of the item being sold are of that item.
- You have disclosed material wear, damage, defects, repairs, alterations, modifications, missing components, and other information reasonably relevant to a buyer.
- Your listing does not infringe another person's intellectual-property, privacy, publicity, or other rights.
- The item complies with the Trail Closet Marketplace Rules and Seller Guidelines.
Sellers are responsible for setting their listing price and selecting the shipping, local-pickup, and return options made available through Trail Closet.
Trail Closet may remove, restrict, modify, flag, or refuse listings that violate these Terms or our policies or that we reasonably believe may expose users or Trail Closet to fraud, safety, legal, or other risks.
5. Fees
There is currently no upfront fee to create a standard Trail Closet listing.
When an item sells, Trail Closet charges the seller a 15% seller fee calculated according to the applicable transaction terms presented through the Service.
Trail Closet does not separately charge sellers payment-processing, card-transaction, or similar processing fees in addition to the seller fee. Trail Closet's own costs of accepting payments are borne by Trail Closet.
Applicable fees will be disclosed through the Service.
Trail Closet may change its fees prospectively by providing notice through the Service or another reasonable method. A later fee change will not retroactively alter the fee terms recorded for a completed transaction.
6. Payments and Seller Payouts
Trail Closet may use one or more third-party payment providers to process purchases and facilitate seller payouts.
By buying or selling through Trail Closet, you authorize Trail Closet and its payment providers to take actions reasonably necessary to administer transactions, including collecting payments, deducting applicable fees, facilitating authorized refunds, and facilitating seller payouts.
Seller payouts are not necessarily immediate.
Trail Closet may delay, place a hold on, reserve, or otherwise restrict a seller payout while a transaction remains incomplete or while a return, refund, delivery problem, dispute, chargeback, suspected fraud, policy violation, or other transaction-related issue is pending or under review.
Sellers are responsible for providing accurate information required to receive payouts and completing identity, tax, banking, business, or other verification required by Trail Closet or its payment providers.
7. Shipping
Unless Trail Closet expressly offers another shipping arrangement, sellers are responsible for packaging and purchasing shipping for sold items.
Sellers are expected to ship sold items within 48 hours of purchase, unless Trail Closet expressly provides otherwise for the transaction.
Sellers must use a trackable ground shipping service permitted by Trail Closet's current shipping requirements. Permitted services may include applicable UPS Ground, FedEx Ground, and USPS Ground Advantage services.
Expedited shipping is not currently part of Trail Closet's standard marketplace shipping program unless Trail Closet expressly makes it available.
The seller must enter accurate carrier, shipping method, and tracking information into Trail Closet when marking an item shipped.
Sellers are responsible for packaging items appropriately.
Sellers are responsible for obtaining carrier insurance sufficient to protect themselves against the risk of loss or damage. Trail Closet does not automatically provide shipping insurance for member shipments.
If a shipment is lost or damaged while in the carrier's possession, the seller is responsible for pursuing any applicable carrier claim. Trail Closet may hold the seller's payout while a delivery problem is being resolved and may take appropriate marketplace action, including facilitating a refund where required under Trail Closet's policies.
8. Local Pickup
A seller may offer local pickup where Trail Closet makes that option available.
Buyers and sellers are responsible for arranging and completing local pickup in accordance with Trail Closet's policies and reasonable safety practices.
Users should not exchange unnecessary personal information through public listings.
Trail Closet may establish procedures for documenting completion of local-pickup transactions.
9. Returns and Refunds
Each seller selects the voluntary-return policy applicable to a listing from the options made available by Trail Closet.
The applicable return policy is displayed on the listing and becomes part of the transaction terms when the buyer completes the purchase.
Where the seller accepts voluntary returns, the buyer must initiate the return within 48 hours after the item is delivered, unless Trail Closet expressly provides a different period for the transaction.
For an ordinary voluntary return, the buyer is responsible for return-shipping costs.
An item must be returned in materially the same condition in which it was received, subject to reasonable inspection.
A seller's decision not to accept voluntary returns does not eliminate Trail Closet's separate protection for items that are materially not as described, counterfeit, fraudulent, or otherwise eligible for protection under Trail Closet's policies.
When a buyer claims an item is materially not as described, Trail Closet may require evidence reasonably sufficient to evaluate the claim. For condition disputes where the state of the package and item upon opening is relevant, Trail Closet may require or give substantial evidentiary weight to a continuous video showing the sealed package before opening, the opening of the package, and the item remaining in view while the claimed discrepancy is documented.
A buyer should not alter, repair, use extensively, dispose of, or otherwise materially change an item while a not-as-described claim is pending unless necessary for safety or authorized by Trail Closet.
If Trail Closet determines that an item was materially not as described and authorizes a return, the seller may be responsible for reasonable return-shipping costs.
Specific procedures, deadlines, evidence requirements, and eligibility rules are described in the Trail Closet Returns & Refunds Policy, which is incorporated into these Terms.
10. Member Communications
Trail Closet may provide messaging tools allowing buyers and sellers to communicate about listings and transactions.
Users should keep transaction-related communications on Trail Closet whenever reasonably possible. Maintaining communications on the platform allows Trail Closet to review relevant information when assisting with buyer/seller protection, fraud, safety, support, or disputes.
You may not use Trail Closet messaging to harass, threaten, deceive, spam, solicit unlawful activity, distribute malicious content, or attempt to circumvent Trail Closet's transaction process.
You may not encourage another user to complete a Trail Closet-originated transaction outside Trail Closet for the purpose of avoiding Trail Closet fees, payment processes, or marketplace protections.
Trail Closet may preserve, review, and disclose messages as described in the Privacy Policy and as reasonably necessary for support, fraud prevention, safety, policy enforcement, dispute resolution, or legal compliance.
11. Prohibited Items and Conduct
You may not use Trail Closet to:
- List or sell stolen, counterfeit, illegal, recalled, prohibited, or restricted products.
- Commit or facilitate fraud or misrepresentation.
- Manipulate prices, transactions, reviews, ratings, search results, or marketplace activity.
- Misrepresent an item's identity, authenticity, ownership, condition, characteristics, or history.
- Upload photographs intended to materially mislead buyers.
- Harass, threaten, abuse, or unlawfully discriminate against another person.
- Attempt to move a Trail Closet-originated transaction off-platform to avoid Trail Closet fees or protections.
- Access another person's account or non-public information without authorization.
- Introduce malware or interfere with the operation, integrity, availability, or security of Trail Closet.
- Scrape, crawl, harvest, reverse engineer, or systematically extract data from the Service except where expressly authorized by Trail Closet or permitted by applicable law.
- Manipulate, probe, circumvent, or attempt to defeat security, authentication, authorization, rate limits, moderation systems, or other safeguards.
- Use the Service in violation of applicable law or Trail Closet's policies.
Additional product and conduct restrictions appear in the Marketplace Rules and Seller Guidelines, which are incorporated into these Terms.
12. Reviews
Trail Closet may permit eligible users to submit ratings and reviews.
Reviews must reflect genuine experiences and may not contain knowingly false information, harassment, unlawful content, manipulation, conflicts that are not appropriately disclosed, or attempts to artificially affect another user's reputation.
Trail Closet may remove, restrict, or decline to publish reviews that violate these Terms or our policies.
13. User Content
You retain ownership of original content you submit to Trail Closet, including listing descriptions, photographs, seller biographies, reviews, and other content ("User Content").
By submitting User Content, you grant Trail Closet a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, process, technically modify or reformat, display, distribute, and use that content as reasonably necessary to operate, secure, improve, and promote Trail Closet and its marketplace.
You represent and warrant that you possess the rights necessary to submit the User Content and grant this license.
This license survives removal of content to the extent reasonably necessary for completed transaction records, backups, fraud prevention, dispute resolution, enforcement, legal compliance, or other legitimate business purposes.
14. Intellectual Property
Trail Closet and its associated software, designs, graphics, logos, trademarks, text, interfaces, and proprietary content are owned by Delack Media Group dba Trail Closet or its licensors and are protected by applicable intellectual-property laws.
Except for the limited right to use the Service under these Terms, no rights in Trail Closet intellectual property are transferred to you.
Product names, trademarks, logos, and brand names belonging to third parties may appear on Trail Closet for purposes such as identifying listed products. Their appearance does not imply sponsorship, affiliation, authorization, or endorsement by those third parties.
15. Reporting and Marketplace Moderation
Trail Closet may provide tools for reporting listings, photographs, users, messages, reviews, suspected fraud, prohibited items, and other potential violations.
Submitting a report does not guarantee removal or other action.
Trail Closet may investigate reports and consider information including listings, photographs, messages, transaction history, reports, account history, shipping information, and other relevant records.
Users may not knowingly submit false, malicious, retaliatory, or abusive reports.
16. Enforcement, Suspension, and Termination
Trail Closet may investigate suspected violations of these Terms or our policies.
Depending on the circumstances, Trail Closet may:
- Warn a user.
- Restrict account functionality.
- Remove or restrict listings, photographs, reviews, or other content.
- Place transactions or payouts on hold.
- Cancel transactions where appropriate.
- Suspend an account.
- Permanently terminate an account.
- Take other reasonable actions necessary to protect Trail Closet or its users.
Account termination does not automatically erase transaction records, messages, support records, reports, financial records, moderation records, or other information Trail Closet reasonably needs to retain for legal, accounting, fraud-prevention, dispute-resolution, security, safety, or operational purposes.
Users may request account closure subject to outstanding transactions, disputes, payment obligations, investigations, and applicable retention requirements.
17. Marketplace Disputes
Buyers and sellers should first attempt to resolve ordinary transaction issues through Trail Closet's communication and support processes.
If the parties cannot resolve an issue, either party may request assistance from Trail Closet where the applicable policies permit.
Trail Closet may review information reasonably relevant to a marketplace dispute, including:
- The listing
- Listing photographs
- Buyer/seller messages
- Shipping and tracking information
- Transaction records
- Return information
- Reports
- Account history
- Photographs or video evidence
- Other evidence submitted by the parties
Trail Closet may determine actions to be taken within its marketplace, including whether to hold or release a payout, facilitate or require a refund where supported by the applicable transaction and payment system, remove content, or restrict an account.
Trail Closet's determination concerning marketplace actions does not eliminate legal rights that cannot lawfully be waived.
18. Third-Party Services
Trail Closet may rely on third-party providers for payment processing, authentication, hosting, email delivery, analytics, storage, security, and other infrastructure or services.
Your use of certain third-party services may also be subject to those providers' terms and privacy policies.
To the fullest extent permitted by applicable law, Trail Closet is not responsible for the independent acts, omissions, availability, or performance of third-party services.
19. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRAIL CLOSET AND THE SERVICE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
TRAIL CLOSET DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT TO THE EXTENT PERMITTED BY LAW.
TRAIL CLOSET DOES NOT WARRANT THAT THE SERVICE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE.
TRAIL CLOSET DOES NOT MANUFACTURE, INSPECT, POSSESS, OR CONTROL MEMBER-LISTED ITEMS AND DOES NOT WARRANT THEIR CONDITION, SAFETY, AUTHENTICITY, LEGALITY, DURABILITY, PERFORMANCE, OR FITNESS FOR A PARTICULAR PURPOSE.
OUTDOOR EQUIPMENT MAY INVOLVE INHERENT RISKS. BUYERS ARE RESPONSIBLE FOR INSPECTING GEAR AND DETERMINING WHETHER AN ITEM IS SAFE AND APPROPRIATE FOR THEIR INTENDED ACTIVITY BEFORE USE. TRAIL CLOSET DOES NOT PROVIDE SAFETY INSPECTIONS OR CERTIFICATIONS OF MEMBER-LISTED EQUIPMENT.
Nothing in these Terms excludes warranties, remedies, or other rights that cannot lawfully be excluded.
20. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DELACK MEDIA GROUP DBA TRAIL CLOSET AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, TRAIL CLOSET'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
(A) the amount of fees you paid directly to Trail Closet during the twelve months preceding the event giving rise to the claim; or
(B) $100.
These exclusions and limitations apply only to the extent permitted by applicable law. Some jurisdictions do not permit certain exclusions or limitations, in which case they apply only to the maximum extent legally permitted.
21. Indemnification
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Delack Media Group dba Trail Closet and its affiliates, officers, directors, employees, agents, successors, and assigns from claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:
- your violation of these Terms or Trail Closet policies;
- items you list, sell, ship, deliver, purchase, or otherwise transact through Trail Closet;
- your User Content;
- your violation of applicable law or another person's rights;
- your fraud, negligence, willful misconduct, or misrepresentation; or
- disputes arising from transactions in which you participated,
except to the extent resulting from Trail Closet's conduct for which liability cannot lawfully be disclaimed or shifted.
22. Arbitration, Governing Law, and Venue
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO HAVE CERTAIN DISPUTES DECIDED BY A COURT OR JURY.
22.1 Agreement to Arbitrate
To the extent permitted by applicable law, you and Delack Media Group dba Trail Closet agree that any controversy, claim, or dispute arising out of or relating to these Terms, your use of Trail Closet, or a transaction conducted through Trail Closet will be resolved by binding arbitration rather than litigation in a court of law, except as expressly provided below.
Arbitration will be conducted before a single arbitrator through ADR Systems, located at 20 North Clark Street, 29th Floor, Chicago, Illinois 60602, under the applicable rules and procedures of ADR Systems.
The arbitrator will have authority to determine the arbitrability of a dispute and to award individual remedies or relief available under applicable law, subject to enforceable limitations contained in these Terms.
Judgment upon an arbitration award may be entered and enforced in any court having jurisdiction.
22.2 Individual Arbitration and Class-Action Waiver
To the extent permitted by applicable law, arbitration under these Terms will be conducted on an individual basis only.
Neither you nor Trail Closet may bring or participate in a class, collective, consolidated, or representative arbitration or action concerning a dispute subject to this arbitration agreement, except where applicable law does not permit such a waiver.
22.3 Exceptions to Arbitration
Either party may pursue an individual claim in small claims court if the claim qualifies for that court and remains solely within its jurisdiction.
Notwithstanding the arbitration requirement, either party may seek temporary, preliminary, or other appropriate injunctive or equitable relief from a court of competent jurisdiction when reasonably necessary to prevent or address actual or threatened misuse of intellectual property, unauthorized access to or interference with Trail Closet systems, fraud, security breaches, or other conduct for which immediate equitable relief is appropriate.
Seeking such relief does not waive the requirement to arbitrate other claims subject to this Section.
22.4 Arbitration Fees and Attorneys' Fees
Arbitration fees and costs will be allocated in accordance with applicable law and the applicable ADR Systems rules.
The arbitrator may award reasonable attorneys' fees and costs when authorized by applicable law or these Terms.
Nothing in these Terms requires a consumer to pay arbitration costs that applicable law requires Trail Closet to pay.
22.5 Governing Law
Except where applicable consumer law requires otherwise, these Terms and disputes arising out of or relating to them or the Service are governed by the laws of the State of Illinois, without regard to conflict-of-law principles.
22.6 Court Proceedings and Venue
For disputes not subject to arbitration, and except where applicable law provides otherwise, you and Trail Closet consent to the exclusive jurisdiction and venue of the state and federal courts located in Cook County, Illinois.
Nothing in this Section deprives a consumer of protections or rights that cannot lawfully be waived under applicable federal, state, or local law.
23. Changes to the Service
Trail Closet may modify, suspend, discontinue, replace, or introduce features of the Service.
Trail Closet does not guarantee that any particular feature will remain available indefinitely.
Where reasonably appropriate, Trail Closet may provide advance notice of material changes substantially affecting users.
24. Changes to These Terms
Trail Closet may update these Terms from time to time.
When we make material changes, we may provide notice through the Service, by email, or through another reasonable method.
Updated Terms will identify their effective or last-updated date.
Your continued use of Trail Closet after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
Changes will not retroactively alter transaction terms already fixed for a completed purchase except where required by law or agreed by the affected parties.
25. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.
26. No Waiver
Trail Closet's failure or delay in exercising a right or enforcing a provision of these Terms does not waive that right or provision.
A waiver on one occasion does not constitute a waiver on another occasion.
27. Assignment
You may not assign or transfer your rights or obligations under these Terms without Trail Closet's prior written consent.
Trail Closet may assign these Terms in connection with a merger, acquisition, corporate reorganization, financing, sale of assets, affiliate restructuring, or similar transaction, subject to applicable law.
28. Survival
Provisions that by their nature should survive termination will survive, including provisions concerning outstanding transactions and payments, intellectual property, applicable User Content licenses, disclaimers, limitations of liability, indemnification, arbitration, governing law, and record retention.
29. Entire Agreement
These Terms, together with policies expressly incorporated by reference, constitute the agreement between you and Trail Closet concerning your use of the Service and supersede prior agreements concerning that subject matter, except for separate written agreements expressly entered into between you and Trail Closet.
